Our websites include europeanmastercertification.com and emcprogram.com, together with any subdomains and successor sites (the "Site").

In these Terms, "we", "us" and "our" mean EMC International BV. "You" means the person using the Site or buying from us. "Content" means everything we make available on the Site: text, images, video, audio, course materials, downloads, software, design and the look and feel of the Site itself.

By using the Site or buying from us, you accept these Terms. If you do not accept them, please do not use the Site.

1. Our content and your licence to use it

1.1 The Site and all Content belong to us or to our licensors and third-party providers. This includes all course material, videos, photographs, artwork, documents, text, code and sound recordings.

1.2 We grant you a limited licence to access, view and use the Site and any Content you have paid for. That licence is personal to you. It is non-exclusive, non-transferable and non-sublicensable.

1.3 You may not copy, reproduce, republish, upload, post, transmit, distribute, sell, or make any commercial use of the Content without our written permission. You may not share your account access with anyone else.

1.4 Where a course is sold to a business or a school, the licence covers only the named participants agreed with us in writing. It does not permit that organisation to teach our material to others.

1.5 The names and marks "European Master Certification", "EMC" and "EMC Program", together with our logos, are ours. Nothing in these Terms gives you a right to use them.

1.6 We respect other people's intellectual property. If you believe something on the Site infringes your rights, write to [email protected] with your name and contact details, a description of your work, where it appears on the Site, and any registration details. We will look into it and remove material where appropriate.

2. Your account

2.1 You are responsible for keeping your login details confidential and for everything done through your account.

2.2 We may suspend or close an account where a person has breached these Terms, shared access, or attempted to copy or redistribute our Content.

2.3 When you register with us, you agree that we may send you notices, agreements, disclosures and other records relating to your purchase electronically, by email.

3. Buying from us

3.1 Prices are shown in euros (€). Where VAT applies, the price shown includes VAT unless stated otherwise.

3.2 Belgian VAT at the standard rate applies to in-person courses held in Belgium, whatever your country of residence.

3.3 For online courses, VAT treatment depends on where you are and whether you are buying as a business:

  • EU business with a valid VAT number: no VAT is charged, and the reverse charge applies under Article 44 of the EU VAT Directive. You must give us your VAT number before payment.
  • Customer outside the EU: no EU VAT is charged.
  • EU consumer without a VAT number: Belgian VAT applies.

3.4 Payments are handled by Stripe. We do not store your card details.

3.5 Where you have chosen a payment plan, you authorise us to collect each instalment on the agreed dates. Access to a course may be suspended while an instalment is overdue.

3.6 A contract between us is formed when we confirm your booking or enrolment by email.

4. Your right to cancel as a consumer

4.1 This section applies if you are a consumer resident in the EU. It does not limit your rights under Belgian or EU consumer law. Where anything else in these Terms conflicts with those rights, your legal rights prevail.

4.2 Online courses and digital content. You normally have 14 days from the day the contract is concluded to withdraw, without giving a reason. If you ask us to start delivering digital content within that period, you must expressly agree that we may begin and acknowledge that you then lose your right of withdrawal once delivery has started. We will ask you to confirm this at checkout.

4.3 In-person courses and events. You normally have 14 days from the day the contract is concluded to withdraw, without giving a reason, provided the event has not yet taken place. Cancellations after that period are handled under section 5.

4.4 To withdraw, email [email protected] before the 14 days expire, saying clearly that you wish to cancel. We will refund you within 14 days of receiving your notice, using the same payment method you used.

5. Cancellation of in-person events after the withdrawal period

5.1 Once the 14-day withdrawal period in section 4 has passed, the following applies to in-person courses and events:

When you cancel What happens
More than 90 days before the event Refund of the amount paid, less the respective secure-your-spot deposit, which is not refundable
31 to 90 days before the event Refund of the amount paid, less €1,000 or 30% of the fee, whichever is greater
30 days or fewer before the event No refund. We issue a credit towards the next running of the same course

5.2 The respective secure-your-spot deposit reserves your place and covers the cost of holding it. It is not refundable.

5.3 Credits are valid for one year from the date of the event you were originally booked on. They cannot be extended or exchanged for cash.

5.4 Cancellation requests must be sent in writing to [email protected]. The date we receive your email is the date we use.

5.5 Places may be transferred to another person by agreement with us in writing, at no charge, up to 14 days before the event.

6. Changes and cancellations by us

6.1 We may change the dates, venue, tutors or programme of a course where we need to. Where a change is significant, we will tell you and you may choose a refund or a place on a later course.

6.2 If we cancel an event outright, you may choose a full refund or a credit towards a later course.

6.3 We are not liable for delay or failure to perform caused by events beyond our reasonable control, including natural disasters, epidemics, fire, war, civil unrest, strikes, and government restrictions or the refusal of any licence. Where such an event forces us to postpone or cancel an in-person course, we will make reasonable efforts to reschedule. Where money has already been paid, we will refund it less any non-recoverable costs we have already committed on your behalf, such as venue or accommodation deposits.

6.4 Requests for repayment under 6.3 should be sent in writing to [email protected].

7. What we do and do not promise

7.1 We take reasonable care to keep the information on the Site accurate and current, but we do not warrant that it is free of errors or omissions.

7.2 The Content is provided for education. We do not promise any particular commercial result, income or level of success. What you achieve depends on your own work, skill, market and circumstances.

7.3 We do not warrant that the Site will be uninterrupted or error-free, or that defects will be corrected.

7.4 We are not responsible for problems caused by third-party services you rely on to reach us, such as your internet provider, your device, or Stripe's payment services. Those relationships are governed by your agreement with that provider.

8. Our liability

8.1 Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot lawfully be excluded.

8.2 Subject to 8.1, we are not liable for indirect or consequential loss, loss of profit, loss of revenue, loss of goodwill, or loss of data.

8.3 Subject to 8.1, our total liability in connection with any course or purchase is limited to the amount you paid us for it.

8.4 If you are a consumer, this section does not affect your statutory rights.

9. Your responsibilities

9.1 You agree not to use the Site unlawfully, or to upload or share material that is unlawful, defamatory, obscene, threatening, or that infringes anyone's rights.

9.2 You agree to compensate us for any loss we suffer as a result of your breach of these Terms, your breach of the law or of a third party's rights, or material you post through the Site.

9.3 At in-person events you must follow the safety instructions given by our staff and the venue. Tools and mechanics used in floral work can cause injury if handled carelessly.

10. Feedback and submissions

10.1 If you send us comments, suggestions, sketches or other material about the Site or our courses, we may use them freely and without payment to you. Please do not send us anything you consider confidential.

10.2 Photographs and video taken at our events may be used by us for teaching and promotion. Tell us in writing before the event if you do not wish to appear, and we will do our best to accommodate you.

11. Your data

11.1 We handle personal data in line with our Privacy Policy, which forms part of these Terms.

11.2 We do not sell your personal data. We share it only where we need to in order to run our courses and take payment, or where the law requires it.

12. Complaints and disputes

12.1 If something has gone wrong, please write to [email protected] first. We would rather sort it out directly.

12.2 If we cannot resolve your complaint, consumers may contact the Belgian Consumer Mediation Service (Consumentenombudsdienst / Service de Médiation pour le Consommateur) at www.consumentenombudsdienst.be.

13. Governing law and jurisdiction

13.1 These Terms and any dispute arising from them are governed by Belgian law.

13.2 The courts of the judicial district of West Flanders, division Bruges, have jurisdiction.

13.3 If you are a consumer, this does not deprive you of the protection of the mandatory law of your country of residence, or of your right to bring proceedings in the courts of that country where the law allows it.

13.4 If any part of these Terms is found to be unenforceable, the rest continues to apply.

14. Changes to these Terms

14.1 We may update these Terms from time to time by publishing a new version on this page, with a new "last updated" date.

14.2 The version in force when you made your purchase is the version that applies to that purchase.
